Membership Agreement
Between
HYEXPERT TRAINING (hereinafter referred to as the “Provider”)
and
the undersigned participant (hereinafter referred to as the “Participant”).
Voluntary Participation and Risk Awareness
Participation in training sessions, classes, and use of the facilities is voluntary.
The Participant acknowledges that HYEXPERT TRAINING includes high-intensity functional exercise, running, sled pushes and pulls, rowing, SkiErg work, strength exercises, cardiovascular training, and similar activities that may involve elevated physical stress and risk of injury.
The Participant acknowledges that physical activity involves risks including injuries, overexertion, falls, cardiovascular strain, accidents involving equipment, and property damage.
The Participant confirms having been informed of and understanding these risks.
2. Voluntary Participation and Risk Awareness
Participation in training sessions, classes, and use of the facilities is voluntary.
The Participant acknowledges that HYEXPERT TRAINING includes high-intensity functional exercise, running, sled pushes and pulls, rowing, SkiErg work, strength exercises, cardiovascular training, and similar activities that may involve elevated physical stress and risk of injury.
The Participant acknowledges that physical activity involves risks including injuries, overexertion, falls, cardiovascular strain, accidents involving equipment, and property damage.
The Participant confirms having been informed of and understanding these risks.
3. Health and Personal Responsibility
The Participant confirms being physically and mentally fit to participate in training.
Existing medical conditions, injuries, or relevant health concerns must be disclosed before participation.
Participants who are pregnant, recovering from surgery, or have known medical conditions affecting exercise participation are responsible for obtaining appropriate medical advice before participating.
The Participant is responsible for stopping training immediately in case of pain, discomfort, dizziness, unusual symptoms, or signs of overexertion.
4. Emergency Medical Treatment
The Participant authorizes the Provider to seek emergency medical assistance if deemed necessary during participation.
Any costs associated with emergency treatment, transportation, or medical care remain solely the responsibility of the Participant.
5. Liability Waiver
Participation is at the Participant's own risk.
To the extent permitted under Swiss law, the Provider accepts no liability for injuries, accidents, health consequences, or property damage arising from participation.
Liability for intent and gross negligence remains unaffected in accordance with mandatory Swiss law.
The Participant is responsible for the proper use of equipment and facilities.
6. Insurance
The Participant confirms having valid health and accident insurance coverage.
Any medical or related costs arising from participation remain the sole responsibility of the Participant.
7. Open Gym Use
Use of the open gym is at the Participant’s own responsibility.
No individual supervision or coaching is provided during unsupervised hours.
All equipment and materials must be used properly and responsibly.
All equipment must be returned to designated places after use.
Training areas must be left clean and tidy.
Any damage or defects must be reported immediately.
8. Property Damage and Personal Belongings
The Participant is liable for damage caused through negligence or misconduct.
The Provider accepts no responsibility for loss, theft, or damage to personal belongings.
9. Rules of Conduct / House Rules
Instructions from staff must be followed.
Respectful behaviour toward staff and participants is mandatory.
Unsafe behaviour, harassment, misuse of equipment, or repeated violations of gym rules may result in exclusion or termination of memberships.
The Provider reserves the right to deny access in cases of serious misconduct.
10. Photo and Video Consent
By participating in Hyexpert Training sessions, the Participant consents to photographs and videos being used for marketing purposes.
·Consent may be withdrawn in writing at any time.
11. Membership / Subscriptions
Memberships are not renewed automatically.
Pauses due to injury may be granted individually with a medical certificate.
Refunds for unused services are excluded.
Holiday suspension: up to two weeks per calendar year upon prior notice.
12. Minor Participants
Participants under 18 require written consent from a parent or legal guardian.
Such consent will be required by email following their purchasing of minor training sessions.
13. Governing Law
This agreement is governed by Swiss law.
Place of jurisdiction is Baselland, Switzerland.
14. Severability Clause
If any provision of this agreement is found invalid or unenforceable, the remaining provisions remain in full force and effect.
The Participant confirms being physically and mentally fit to participate in training.

CONSENT
By submitting the form below, the Participant confirms having read and understood this agreement.
